Dhankhar invokes Article 167 to seek all records and proceedings leading to Inquiry Commission regarding Pegasus notification

West Bengal Governor Jagdeep Dhankhar on Monday invoked Article 167 of the Constitution to seek from the Mamata Banerjee Government all records and proceedings leading to Inquiry Commission on Pegasus notification.
Taking to Twitter, Dhankhar said, " Constrained to invoke Article 167 of the Constitution to [email protected] all record and proceedings leading to Inquiry Commission #Pegasus Notification dated 26.07.2021 as the Chief Secretary Hari Krishna Dwivedi @IASassociation failed to provide such information. "

@MamataOfficial indicate that Section 5 (2)-(5) and Section 5A of Commissions of Inquiry Act, 1952 have been made applicable to the proceedings #Pegasus Inquiry Commission. premised on the “opinion of the Governor. "

was ever sent to Governor prior to Notification dated 26.07.2021. There could obviously be no formation of any opinion by Governor and there has been none as a matter of fact, " he added.
Earlier, Dhankhar called upon State Chief Secretary H K Dwivedi to make available the entire record leading to the issuance of July 26 notification regarding Pegasus Inquiry Panel, precisely also reflecting the formation of ‘opinion’ by Governor in the matter latest by December 18.
