Agartala, 15th September 2026 : The Tripura High Court has intervened in proceedings initiated by the Tripura Human Rights Commission over an anonymous complaint filed against Nachiketa Mittal, Registrar of Tripura Law University.
In WP(C) No. 646 of 2026, a Division Bench comprising Chief Justice M. S. Ramachandra Rao and Justice Biswajit Palit has imposed an interim stay on all further proceedings arising out of the Commission’s order dated August 14, 2026.
In its prima facie observations, the Court noted that since the complaint was anonymous, the question of its rejection at the threshold under Regulation 9 of the Tripura Human Rights Commission Regulations ought to have been considered. The Court also prima facie observed that the allegations raised in the complaint did not appear, on the face of it, to constitute direct violations of human rights.
At the same time, the Court observed that, depending on the nature of the allegations, other legal provisions could potentially be applicable if an aggrieved person comes forward and makes a complaint personally. These may include provisions under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, or the Bharatiya Nagarik Suraksha Sanhita, 2023, as applicable.
The High Court has issued notice to the Tripura Human Rights Commission and its Investigation Wing in the matter. Kohinoor N. Bhattacharjee, appearing for the government, accepted the notice.
The Court has not finally decided the case at this stage. The matter has been listed for further hearing on November 18, 2026.
As a result of the interim order, all subsequent proceedings pursuant to the Tripura Human Rights Commission’s August 14, 2026 order will remain stayed for the time being.
