Court awards man for 12 years of imprisonment for raping Sister-in-law

Agartala, 19th February 2024 :   In a landmark judgment, the District and Session Court of Gomati convicted one Rajib Karmakar, a resident of Phatik Sagar area in Amarpur, for abducting and raping his sister-in-law. The court sentenced Karmakar to suffer 12 years jail along with fines and additional penalties.

The court found Karmakar guilty under Section 363 of the Indian Penal Code for the abduction of his sister-in-law, sentencing him to 3 years imprisonment and imposing a fine of Rs 3,000. In default of the fine, Karmakar will serve an additional one-month imprisonment.

Additionally, Karmakar was convicted under the Protection of Children from Sexual Offences (POCSO) Act for the repeated sexual assault on his sister-in-law during their stay in Chennai. The court sentenced him to 12 years imprisonment, a fine of RS 10,000, and an additional three months imprisonment in default.

The case unfolded when Karmakar, facing allegations of domestic abuse towards his wife, resorted to abducting his sister-in-law after making inappropriate proposals. The court heard testimonies from 16 witnesses during the proceedings.

Karmakar forcibly took his sister-in-law to Chennai, where he rented a house and lived with her under the guise of marriage. Multiple instances of rape were reported during their stay in Chennai, leading to a case being filed at Kankraban police station by the father-in-law.

The police arrested Karmakar upon his return to the state with his sister-in-law. The court’s verdict sends a strong message against such heinous crimes, emphasizing the severity of the punishment for offenses under the POCSO Act.

This judgment serves as a significant step towards ensuring justice for victims of sexual assault and abduction, highlighting the commitment of the legal system to protect individuals from such atrocities.
