Diocese of Agartala raises allegation of unlawful demolition

Agartala, 30th May 2026:   Officials from the office of the Deputy Collector & Magistrate, Barjala Revenue Circle, accompanied by police personnel, allegedly bypassed due legal process and unlawfully demolished the boundary wall standing within the legally owned land of the Diocese of Agartala.

According to the complainant, the Diocese is the rightful owner of RS Plot Nos. 8548, 8550, and 8551, having purchased them from a bona fide seller. The ownership has been duly recorded in the Record of Rights and affirmed by a decree of the Learned Civil Judge (Sr. Division), Court No. 2, Agartala, West Tripura.

Sources indicate that the Revenue Authority arbitrarily reclassified the plots as Government Khas land, directly contradicting the court’s decree. Such reclassification is void and non-est in law. The Diocese has challenged this arbitrary order before the Hon’ble High Court of Tripura by filing WP(C) No. 358 of 2026, which has been admitted and remains sub judice.

A legal notice dated 27 May 2026 was served upon the Deputy Collector & Magistrate, Barjala Revenue Circle, through Advocate Mr. Prabal Kumar Ghosh, specifically requesting that the authority refrain from disturbing the complainant’s peaceful possession of the land pending the writ petition.

Despite the notice and the ongoing High Court proceedings, on 30 May 2026, officials unlawfully and forcibly demolished the boundary wall on the complainant’s land. This act, carried out without lawful authority, constitutes contemptuous disregard of judicial proceedings.

The demolition amounts to criminal mischief under Section 324 BNS / Section 425 IPC, unlawful interference with property, and deliberate disobedience of a pending judicial matter, potentially attracting contempt of court proceedings.
