Tripura Moves to implement Recovery of Damages to Public and Private Property Act After Post-Election Violence

Agartala, 24th April 2026:   In response to the recent violence reported after the declaration of results for the Tripura Tribal Areas Autonomous District Council elections on April 17, the state government is preparing to strictly implement the Tripura Recovery of Damages to Public and Private Property Act, 2021. Officials say the focus is now shifting toward ensuring financial accountability for destruction caused during such incidents.

The unrest that followed the election results reportedly displaced more than 200 residents and resulted in widespread damage to homes, public assets, and private property, prompting concern over enforcement of existing legal mechanisms.

A senior police official noted that while the Act was introduced in 2021 to address destruction arising from riots, protests, strikes, and similar disturbances, its application has remained limited in practice until now. The current situation, however, has pushed authorities to activate its full provisions.

Under the Act, Claims Tribunals are responsible for assessing the extent of damage and determining compensation. A Claims Commissioner, typically an Additional District Magistrate or above, is appointed to supervise proceedings. The law treats all forms of loss or destruction caused by individuals or groups as “damages,” and aligns “mischief” with the definition under Section 425 of the Indian Penal Code.

Police are required to submit detailed reports to the tribunal within three months of any incident. Based on these reports, the tribunal calculates compensation to be recovered from those found responsible, while criminal investigations proceed independently.

Chief Minister Manik Saha, who visited affected areas to review the situation firsthand, has already approved ₹64.5 lakh from the Chief Minister’s Relief Fund to provide immediate relief to victims.

Authorities have indicated that stricter enforcement of the Act is intended not only to support victims but also to deter future incidents by ensuring that financial liability is imposed on those responsible for destruction.
