SC refuses to transfer trial of RG Kar doctor rape-murder case outside West Bengal

The Supreme Court on Thursday refused to transfer the trial of the RG Kar trainee doctor rape-murder case from West Bengal to another State.

A three-judge bench comprising Chief Justice of India Dr DY Chandrachud, Justice JB Pardiwal and Justice Manoj Misra while hearing the suo moto case related to the rape-murder of a junior doctor of the RG Kar Medical College Hospital, Kolkata said that the Supreme Court will not interfere with the powers of the trial court.

When an oral request was made before the Court to shift the trial out of West Bengal, the Court said that it was not going to pass any such order.

The incident took place on August 9.

The Bench then went through the status report of the CBI investigation

The CJI said, “We have seen the 6th status report filed by CBI. This indicates that the Additional Sessions judge has framed charges punishable under sections 64 and 103 of BNSS and its next hearing is on November 11.

We will not interfere in this, no such transfers,” he said.

The CBI apprised the Court that on November 4, 2024, Additional Sessions Judge, Sealdah framed charges against the accused Sanjay Roy and the case is posted next on November 11 for the opening of prosecution evidence.

The National Task Force, constituted by the Court to give suggestions to enhance the safety of medical professionals, also submitted its report.

The Court directed that a copy of the NTF report be shared with all parties in the case, the Chief Secretaries of all States/UTs to give recommendations, Justice Chandrachud said.

Advocate Kanu Agrawal appearing for the Union filed the report of the National Task Force.

The entire report has short-term, long term and medium-term measures. It is divided into three parts, Kanu Agrawal said.

Since the investigation is underway we refrain from making observations, Let an updated status report be filed after 4 weeks, the CJI said.
