SC defers Tahir Hussain interim plea to Wednesday

 The Supreme Court on Tuesday deferred the hearing on the interim bail plea of AIMIM candidate and Delhi riots accused Tahir Hussain.

Tahir Hussain, an accused in the 2020 Delhi riots, is contesting as an AIMIM candidate from the Mustafabad constituency.

A bench comprising Justice Pankaj Mithal and Justice Ahsanuddin Amanullah had yesterday while hearing his interim bail plea passed the remarks that “Such persons should be barred from contesting.”

All India Majlis-e-Ittehadul Muslimeen (AIMIM) candidate and Delhi Riots case accused Mohd Tahir Hussain moved the Supreme Court seeking interim bail to campaign for the upcoming Delhi Assembly elections.

Hussain’s plea was listed today but the court deferred it to tomorrow,

Senior Advocate Siddharth Aggarwal, representing Hussain, said that when he has been granted bail in 9 cases related to the Delhi riots why can he not get bail in this case?

The bench directed that the case be listed for tomorrow.

Aggarwal informed the Court that the Delhi High Court had granted Hussain custody parole on January 14 to file his nomination papers, which have since been accepted.

He urged the Court to grant interim bail to Hussain so that he could actively campaign ahead of the election date on February 5./

Hussain, a former Aam Aadmi Party councillor, is facing charges in connection with the murder of Intelligence Bureau (IB) staffer Ankit Sharma during the 2020 North-East Delhi riots.

In March 2024, the trial court framed charges against Hussain and others Earlier, Hussain had approached the Delhi High Court seeking interim bail.

The Delhi Police opposed his plea but agreed to facilitate his filing of nomination papers by granting him custody parole.

On January 14, the High Court denied him interim bail as there are severe allegations of being the main perpetrator in the riots that claimed the lives of 59 individuals. thereafter he approached the Supreme Court seeking time to campaign for the upcoming elections in Delhi.

The Supreme Court has now listed his matter for Wednesday.
